Dear Mr. Ardehali,

We are in receipt of the above mentioned letters.

All Official Records of the Association (Specifications, Bids, and Invoices) are available for review in the Condominium office during regular business hours. The Association does not prepare "reports", but has the actual invoices, contracts, change orders and payment receipts. Our contract for the pool deck renovation is based upon a stipulated sum, not unit prices based upon the cost of labor and materials per brick or per square foot. However, all the documentation we have on file regarding the project is available to you for review. Please call the office for an appointment to view the same.
I ask you in the Board meeting for records, you say I should collect them at the office. I stop at the office, Marcela, demands letter of request, I write letter of request to you, you suggest I go to the office. You and Marcela together have created a never ending circle.

Who authorized you to change the Architectural integrity and character of building from concert to tiles? Did you receive permission from Condo Association?

Approximately 80% of your work is tile and brick works. How is it that you are incapable of telling us price per square foot? We like to know if the ground we are walking on is GOLD, SILVER or CLAY ?
Pursuant to Florida Law, we are not obligated to cull through records, copy them at the Association's expense and mail them to you. It is your responsibility to review these documents at the Office.

You spent $2,600,000 of our money without giving details and ways the money was spent.

Now you claim that you are worried about the cost associated with few pages of copy from our copy machine in our own office???

In answer to your inquiry of December 13 with regard to the windows, the Association repaired and/or replaced windows damaged as a result of Hurricane Wilma as a result of a mandate issued by the Division of Florida Land Sales, Condominiums and Mobile Homes. The Division has regulatory control over all condominiums in the State of Florida. We did not want to pay for unit owner windows, but had no choice.
Did you receive any compensations from the State of Florida For the Hurricane damage?
Please also be advised that the board has worked and continues to work with a structural engineer. We take our responsibilities very seriously and spend countless hours working on Association issues. As you should know, we have incurred expenses as a result of the hurricane and changes to the law (the generator), but the concrete restoration and other repairs are long overdue which contributes to the costs of the project.
What is the power of proposed generator? Are you authorized by the Condominium Association to buy this unit? or are you going to use your creative loophole of several payment of $35,000 for total of $150,000 to avoid permission?
You made several comments regarding Association counsel. Let me tell you, our counsel does not just agree with whatever the Board desires. We did not want to pay for windows and fought our counsel on that issue but when push came to shove and the Division was going to fine us, we followed counsel's advice and took care of the windows.
The counsel works for Condo Association and is paid by the Condo Association. Counsel should respect our Articles of Associations and its By Laws. The law  in the State of Florida permits proxy participations for quorum (if accepted by the By Laws of each individual Association). But our Articles of Association requires 4 persons majority present in the Board of Directors for the quorum. What part this is hard for you to understand?
Finally, everyone on the board is a member of the Association and a unit owner. We too have to pay for all of the expenses, construction costs, etc. I can assure you that none of us want to spend money unnecessarily or spend more than we have to as our own personal expenses (taxes, insurance, etc.) have also increased.

1- Letter from Cyrus Ardehali  to Playa Del Sole Association Board of Directors date: 11/27/06

Dear Sir;

1- I am referring to your scheduled meeting of 11/22/06 at 7.30 pm. In my opinion this meeting of Board of Directors was out of order due to lack of quorum.

(Article of association requires at the minimum 4 out of 7 board member to be present for the Board to have quorum)

I am attaching a copy of the Articles of Association (quorum section) to this letter. Please underline where it say a none present Board member can bring quorum to the Board.

2- There are chatters about expenditure of $650,000 for the repair of the swimming pool.

Please provide me with the details (Labor and materials) used for the repair of the swimming pool.

3- All the items in your 2007 budget lists has to be explained to the condo owners and further justified. A summary report without any justifications is not sufficient for me to authorize you to spend my money.

4- I oppose the renovation of the roof together with any extra none essential expenditures in 2007.

Please arrange for an appropriate Board of Directors meeting in accordance with the rules and regulations stated in the Articles of Association to examine the 2006 expenditure and approve the proposed 2007 budget.

Having president of our Association managing the repairs and implementations of all upgrade works together with a Florid licensed lawyer on our Board, these affairs are expected to move much more smoother.
